Terms and Conditions

Agreement to these Terms and Conditions is between you and Balanced with Wildlife Pty Ltd (ACN 137 185 070).

Balanced with Wildlife Pty Ltd and all affiliated companies respect the intellectual property of others, and we require users of our products and services to do the same. The unauthorised reproduction, copying, distribution, modification, public display, public performance, communication, or use of copyright works constitutes infringement of the copyright owner's rights. In view of the above, you agree not to infringe on the intellectual property rights of any person, including Balanced with Wildlife Pty Ltd, in any way. We will terminate the account of any user who infringes the copyrights, or other intellectual property rights of others. We reserve the right to take these actions at any time, with or without notice and without any liability to you or the user whose access is terminated. You acknowledge that the courses themselves are subject to copyright and other intellectual property laws. Except where a course expressly authorises you to do so, you must not copy, download or print any material from the course or distribute or broadcast any such material. You must not take extracts from the course and/or pretend that those extracts are your own work. You must keep the details of the course content confidential.

Balanced with Wildlife Pty Ltd requires personal information about you to allow it to create an account for you to access course content. Such information may include, but is not limited to, your name, postal address, email address, contact phone numbers, department, business unit, course names attempted or completed and courses completion dates. Balanced with Wildlife Pty Ltd may supply this information to third parties, eg. your employer and any entity where we are required to do so by law. You acknowledge that your authorise Balanced with Wildlife Pty Ltd to provide this information to third parties, as required.

Balanced with Wildlife Pty Ltd may, on occasion, use the personal information you have provided in order to contact you in relation to future courses, products and services. You hereby give Balanced with Wildlife Pty Ltd approval to contact you in relation to future courses, products and services and will notify Balanced with Wildlife Pty Ltd by email at any time in the future when you no longer wish to receive these notifications. Balanced with Wildlife Pty Ltd acknowledges that once email notification has been received from you requesting no future correspondence, it will no longer contact you in relation to future courses, products and services.

You agree that Balanced with Wildlife Pty Ltd is not liable for any loss, liability, cost, expense or damage (including without limitation legal fees) whether arising directly or indirectly, in contract, tort (including negligence) or otherwise, that you or anyone associated with you suffers as a result of your use of the Balanced with Wildlife Pty Ltd training or equipment, or any omissions or defects in such training or equipment. In consideration for being permitted to enrol in any training courses, or equipment purchases you have selected, you indemnify and hold harmless Balanced with Wildlife Pty Ltd for any loss, liability, cost, expense or damage, including without limitation reasonable attorney's fees, that Balanced with Wildlife Pty Ltd suffers as a result of your training or equipment purchase.

Balanced with Wildlife Pty Ltd Presentations/Training Courses Terms And Conditions

Presentations and/or training courses provided by Balanced with Wildlife Pty Ltd are usually provided in (but not limited to) two formats - online training courses and "in person" training courses and awareness sessions.

Payment for online training courses must be received prior to course commencement. On receipt of payment, Balanced with Wildlife Pty Ltd will provide participants with log-in details in the form of a username and password for access to the online course content.

Payment for "in person" training courses and awareness sessions is in the form of a 50% non-refundable deposit which must be paid prior to confirming course dates, followed by the 50% balance of the total course cost, which must be paid at least 48 hours prior to course commencement.

On payment of the non-refundable deposit, Balanced with Wildlife Pty Ltd will book and pay for all travel and accommodation (where required), will book freight for livestock and training equipment and will arrange all licences and permits relating to the presentation.

Unless prior payment arrangements have been agreed upon, if payment of the balance invoice is not received prior to 48 hours before course commencement, Balanced with Wildlife Pty Ltd reserves the right to cancel any course and/or presentation and you agree that Balanced with Wildlife Pty Ltd will not be liable for any loss, liability, cost, expense or damage (including without limitation legal fees) arising directly or indirectly, in contract, tort (including negligence) or otherwise, that you or anyone associated with you suffers as a result of this course and/or presentation cancellation.

The safety and wellbeing of participants, instructors and livestock is paramount on all Balanced with Wildlife Pty Ltd courses and with this in mind if, at any time during any course or presentation, instructors believe that the actions of any participant may endanger themselves, other participants, the instructors or livestock, the instructors reserve the right to immediately suspend the presentation or course and refuse further training to the participant/s of concern. If any participant/s are refused further training as a result of their actions Balanced with Wildlife Pty Ltd will not be liable for any loss, liability, cost, expense or damage (including without limitation legal fees) arising directly or indirectly, in contract, tort (including negligence) or otherwise, that the participant/s refused further training suffers as a result of their suspension from the course and/or presentation.

You further agree that payment of the 50% non-refundable deposit is an indication that you have read, understood and agreed to these Terms and Conditions.
